The thread of the top 3 topic made me think. Do any of you everr give kick backs or (referral fees) or bird dogs as i have heard someone call them, to banquet centers. If you do explain why and how much. I'm cuious because i have heard of someone in my area doing this and i don't think its really fair to the rest of us.

Actually, it's illegal under the heading of racketeering.

Hey Donny...
As unfair as I believe this practice is...why is this illegal? I'm not seeing this as racketeering. If it is...I know who I will be turning in

We've done similar with fraternal houses.

The FOP, VFW, Moose etc are non-profits. They're often loyal to mobiles who are professional and prefer to stick with one they can trust. On occasion we'll get a referral from the managers, ie a "DJ suggestion" for someone who is renting the hall.

In return we'll cut the house a break when they book us for an engagement of their own. The referrals more than make up for the occasional break.

No money changes hands and we don't advertise the practice. Yet it works well and keeps everyone happy. :thumbup

A quote from the article:

<div class='quotetop'>QUOTE</div><div class='quotemain'>The legal principle that applies in these cases is the law of agency, which requires that the planner (or vendor, or accounting firm) represent the interests of only one side of a transaction. Receiving payment from both a client and a subcontractor is an act of dual agency, something that is generally verboten.[/b][/quote]

I'll look for other legal sources in the next couple of days.
