DJMC,

Please advise. I would like to read about this. The new partner I work with loves this "CD Favor" idea. I do not.

Hey guys:

I'm missing the whole idea of the conversation that took place at the wedj.com forums. Can anyone here fill me in? I want to know what you guys think of this issue and why or why this may not be a good idea.

The reason it is not a good idea is b/c it is ILLEGAL to copy a song "for profit"

Since the disc is made pursuant to a profit making enterprise, even giving the disc away for "free" doesn't work since you're doing it as part of your DJ service.

The only ones who seem to be able to get away with this is the B/G themselves, as they are providing a memento for family and friends. Though technically "illegal," they aren't doing it for profit and therefore won't be prosecuted.

However, a DJ service does this WITH THE EXPECTATION OF MONETARY GAIN. Even if this customer doesn't pay the DJ directly for the memento CD, your "gain" comes from the expectation of referrals (future profit). Therefore, the disc was made "pursuant to a profit making enterprise" and the DJ is liable for penalties of $10,000 PER SONG.

On an 18 song CD, this would be a fine of $180,000 per disc. Multiplied by 100 discs: $1,800,000.

All its gonna take is ONE DJ company to get busted for this practice, and the rest will fall like dominos!

anyone wanna bet RLO PRODUCTIONS (Baltimore, MD) will be the first DJ to go down?

Moral of story:
IF YOU'RE DOING ANYTHING ILLEGAL, DON'T BECOME A CHAT BOARD MODERATOR! then, if you're guilty, don't delete the thread about it because it makes you even more guilty.

I just sent your response to my partner so that he can think twice about doing something like this. I've always felt uncomfortable with this practice and really don't want to participate in it.

Below is the link that a bride posted about the 'DJ in question'. The thread got hot when he said he has not done this in quite sometime. Yet a web archive showed the wedding favor page as updated mid June. Hmmmmm...
He also said he used a 'recording studio for voice overs. Hmmmmm... Stopped doing it when it was too expensive to pay royalties. If that the case, why get all fussy?
He then proscribed to post my main page text for 'hidden keywords' of a local DJ service I am friends with (and compete with as well).
I replied saying he was not playing fair. I just posted a link but he copied text from my page and posted it. Then, the thread went silent.

FTR - I have no personal vendetta against him, just asked for fellow DJs opinions. After DJMC posted, Russ got all fussy and accusing us of nitpicking. Anyhow, this DJ lives in the same town as me but we never crossed paths. If we do, I'll just say greetings and go about my business.
